Power of Attorney

A Power of Attorney is a way of giving someone else permission to make decisions about your money and property as well as your health and personal welfare.

Just as a Will is important, a Power of Attorney is equally important and something which most of us should consider having in place. This isn’t just for older people, sudden accident or illness can happen to anyone at any stage in life and if you are unable to administer your own affairs, a Power of Attorney can prove to be vitally important.

A Power of Attorney is a formal legal document in which you allow someone else to manage your affairs on your behalf. Once in place it will give you and your family peace of mind and can help prevent stressful situations from developing and difficult decisions such as who will access your bank account, pay your family’s bills, decide where you should live, run your business or manage any other legal or financial affairs for you.

Different attorneys can be appointed for each type of power of attorney. A Continuing Power of Attorney can be used to help with financial matters before you are incapable but decisions about your welfare cannot be made until you are no longer able to do so yourself.

There are various types of Power of Attorney, ranging from giving an individual authority to sign important documents in your brief or temporary absence, to Welfare Power of Attorney enabling your chosen attorney to act on your behalf in the event of loss of capacity.

  • A Power of Attorney can include decisions about your money and property. This is called a Continuing Power of Attorney.
  • A Welfare Power of Attorney relates to your future health or personal welfare.
